EU/EEA and UK Consumer Rights and Withdrawal Notice

Effective: August 11, 2026
Version: 1.2

This Notice applies when you purchase EVELI mainly for personal purposes and are habitually resident in the EU/EEA or United Kingdom. It forms part of the Terms of Service and does not limit stronger local rights.

Eveli, Inc.
Attn: Legal

Support: [email protected]

EVELI does not offer customer service by telephone. Direct communication is available through the email addresses above and the online billing route. If EVELI later makes a business telephone line available, it will publish that number here.

2. Pre-purchase information

Immediately before purchase, EVELI displays:

The final button uses unambiguous payment language. EVELI sends a durable confirmation after purchase containing the order details, accepted policy versions and withdrawal form.

3. Fourteen-day withdrawal right

You ordinarily have 14 days from the day after the contract is concluded to withdraw without giving a reason.

If EVELI fails to give legally required withdrawal information, the withdrawal period may be extended by up to 12 months under applicable EU/UK law. Giving the missing information later may start a shorter corrective period prescribed by law.

To withdraw, email [email protected] or send any clear statement to the postal address above before the deadline. If EVELI adds a self-service withdrawal control, it will provide an equivalent direct route from billing. You may use the model form below, but it is not mandatory.

4. Immediate access and performance

EVELI is a mixed digital service that can supply generated digital content immediately. Checkout presents two separate, optional choices before the 14-day period ends:

  1. an express request that EVELI begin performing the continuing service immediately; and
  2. prior express consent to supply each specifically requested item of digital content immediately, together with acknowledgement that the withdrawal right for that supplied item is lost when supply begins, to the extent applicable law permits.

If you make those choices:

  1. EVELI may begin the continuing service during the withdrawal period;
  2. once a specifically requested digital-content item is supplied, the withdrawal right for that item is lost where the statutory conditions are met; and
  3. if you withdraw while continuing service performance is incomplete, EVELI may charge only a proportionate amount for service actually supplied where law permits and the required request was captured.

If you do not request immediate access, EVELI must delay paid generation access until the withdrawal period expires. Refusing immediate access does not enroll you in marketing or reduce other rights.

5. Refund calculation

If you validly withdraw before Service performance or digital-content supply begins, EVELI refunds the payment in full.

If performance began at your express request, any lawful deduction will be transparent and proportionate. Classification and deduction rules differ by country and by whether a charge relates to continuing service or already-supplied digital content. Subject to mandatory local law, EVELI's default method for the continuing service component of a credit-metered plan is:

applicable monthly service value × credits consumed during the withdrawal period ÷ credits allocated for that monthly period, capped at the amount paid. For an annual plan, the applicable monthly service value is the annual subscription price divided by 12.

EVELI will not deduct for technically failed generations. Digital content already supplied after valid consent and acknowledgement is treated under the applicable loss-of-withdrawal rule, not charged again through the formula. If the formula would be unfair or inconsistent with mandatory local law, EVELI will use the legally required lower deduction.

Refunds are made without undue delay and no later than 14 days after EVELI receives the withdrawal notice, using the original payment method unless you expressly agree otherwise. EVELI does not charge a refund fee.

6. Conformity and remedies

EVELI's digital service and digital content remain subject to mandatory legal guarantees. Depending on applicable law, you may be entitled to correction, repeat performance, restoration of conformity, price reduction, termination or refund when the Service does not conform to the contract or is not supplied with required care and skill.

Aesthetic preference alone is not non-conformity when the generation technically performed as described. This does not excuse a technical defect, misleading description, missing paid functionality or breach of a mandatory guarantee.

7. Renewal and cancellation

You can stop renewal at any time through Credits → Manage plan and the Stripe Billing Portal. Cancellation is online, direct and does not require a call, survey or retention interaction.

EVELI will comply with legally required renewal reminders and post-renewal cooling-off rights. UK subscription rules scheduled for January 2027 will be implemented before they take effect, including covered reminder, easy-exit, renewal cooling-off and refund duties.

8. Complaints and courts

Send complaints to [email protected]. EVELI will acknowledge a consumer complaint promptly and aim to provide a substantive response within 14 days.

You may use courts and consumer-enforcement bodies available under the mandatory law of your residence. U.S. arbitration provisions do not apply to EU/EEA or UK consumers. EVELI does not currently commit to a voluntary alternative-dispute-resolution provider unless required by applicable national law.

9. Model withdrawal form

Complete and send this form only if you wish to withdraw:
